Revised Vento injury to feelings awards bands in force from 11 September 2017

The ET Presidents have published their response to the judicial consultation on revised Vento bands for awards for injury to feelings and psychiatric injury, which sets new bands to come into force on 11 September 2017.

The ET Presidents have published their response to the judicial consultation on the revised Vento bands for ET awards for injury to feelings and psychiatric injury following the CA’s ruling in De Souza v Vinci Construction (UK) Ltd that the 10% Simmonds general uplift to damages in civil claims should apply. The response sets out the reasoning for setting the new bands which will apply to claims presented to the ET on or after 11 September 2017 and are as follows: (i) Lower band of £800 to £8,400; (ii) Middle band of £8,400 to £25,200; and (iii) Upper band of £25,200 to £42,000 (the most serious cases), with the most exceptional cases capable of exceeding £42,000.
