The Trade Union and Labour Relations (Consolidation) Act 1992 (Amendment) Order 2013 has been published and will come into force on 6th April 2013. The Order amends the Trade Union and Labour Relations (Consolidation) Act 1992 to reduce from 90 to 45 days: (i) the minimum number of days which must elapse before the first dismissal can take effect in cases where it is proposed to dismiss 100 or more employees as redundant within a period of 90 days or less; and (ii) the minimum period of notice before the first dismissal takes effect which the employer must give to the Secretary of State in cases where 100 redundancies are proposed within a period of 90 days or less. Note there is no change to the 30-day minimum period for 20-99 redundancies. The Order also excludes the expiry of fixed term contracts from the scope of collective redundancy consultation, but dismissals before the end of a fixed-term will still be covered.
