Regulations have been published which increase the period of incapacity that triggers the employer’s duty to make a report to the relevant enforcing authority following an accident at work.

Under the Reporting of Injuries, Diseases and Dangerous Occurrences (Amendment) Regulations 2012 (SI 2012/199) the following amendments have been made to Regulation 3(2) of the Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 1995: (i) the period of incapacitation is increased from over 3 days, to over 7 days before the injury or accident which led to the incapacitation is required to be reported to the enforcing authority; (ii) the period of time before a report concerning an occupational injury, or accident has to be submitted increases from 10 days to 15 days. The amendments come into force on 6 April 2012. The HSE guide has been updated accordingly.
